Scope

Our general terms and conditions of sale apply to the online sale of licences for Avast Antivirus software products through AntivirusEdition.com.  Avast software products are edited by AVAST Software a.s. (hereinafter known as "the editor").  All internet users can view the general terms and conditions of sale at www.AntivirusEdition.com (hereinafter known as the website.)

The general terms and conditions of sale are open to amendment.  You will be subject to the terms and conditions of sale published on the website on the date of your order.  The present general terms and conditions of sale are exclusively applied between the company EU4CMS (hereinafter known as we) and any person (hereinafter known as you or the customer) trying to buy or buying a product from www.AntivirusEdition.com.

Prices

The prices listed on the website are the official public prices provided by AVAST Software a.s. and are effective at the time of your order. Prices are shown and charged in Euros including all French taxes. Our VAT number is FR77421597071.

Payment

We accept online payments using Visa or MasterCard.  We also accept payment by cheque, bank transfer or postal order.  Cheques must be made out in Euros and must be issued by a French bank.  Bank card payments are made via CIC Bank's secure server ensuring both security and confidentiality.

Delivery

Your licence key is delivered online along with your invoice after payment.  You will not receive a CD or boxed software through the post.  As soon as your payment has been received and confirmed an email is sent to notify you that your invoice and licence key are available on our website and accessible from your customer account.  In the unlikely event you do not receive this email notification please contact us by email using the contact form indicating your name and your order number and order date.  To prevent the loss of digital date we suggest you copy or print your licence key and invoice as soon as you receive them.

Right to cancel and return the product

Due to the intangible nature of the service whereby completion begins with the customer’s approval before the end of the cancellation period, the customer acknowledges and accepts that their right to cancel services/products within 7 days cannot be exercised in this case according to articles L121-20-2 and following the General Sales Code.  The purchase of a licence is therefore fixed and definitive and no exchanges or refunds will be made.

Data privacy policy and confidentiality

We need your personal details and data to carry out your order and for business communications.  We may need to inform you via email of software updates or the availability of new services.  This site has been declared to CNIL(Freedom of information office) registration number 1338061, for recording EU4CMS's company data.  In accordance with article 34 of the Freedom of Information act dated the 6 January 1978, you have the right to access, rectify, change or delete information about yourself.  You can exercise this right by contact us by post.  We never communicate information to third parties.   The information you give us is only stored so that we can answer your queries and meet your expectations.  We never have access to your bank card details when you buy online.  Your bank card number is registered directly with CIC Bank's secure server ensuring complete confidentiality.  The server only informs us whether the payment has been accepted or rejected.  No "cookies" are used when you visit our website.

Your commitment

You commit to:

·  respecting the software's terms of use once you have installed it.

It is your responsibility to carefully check the details of your order before proceeding to payment. By proceeding to payment you are committed to paying the software licence price listed on the website at the moment of purchase.  If you do not respect these commitments or you do not pay for your order (cheque refused or bank card payment denied) we could cancel you licence key without prior warning.

Courtesy clause

We would like to inform our customers and resellers that our teams are made up of dedicated humans who do everything possible to respond to your requests within a reasonable time, often less than 24 hours. However, it may happen that elements beyond our control, such as server updates from third parties such as Avast, may cause delays in our operations.

Our teams also strive to demonstrate courtesy and respect to all our customers and resellers. In return, we expect the same courtesy and respect from our customers and resellers. Therefore, insults, threats and degrading messages directed against our teams will not be tolerated.

In the event of such situations, we will be obliged to take appropriate measures, such as closing the customer's or reseller's account and ending our mutual collaboration. We thank you for your understanding and cooperation.

Limitation of liability

We can not guarantee that Avast software will always be available and in perfect working order as it belongs to the editing company AVAST Software a.s..  We are an official retailer and distributor of licence keys for AVAST Software a.s. Antivirus solutions.  You must ensure your own protection regarding the loss of data.  A new installation or modified installation could lead to a risk of losing data therefore you must ensure the security of your data.  The customer is the only person responsible for using Avast software and cannot get us to assume liability for any claims or procedures that could be made against him..

Cessation of liability

The customer is not authorised to grant or transfer the rights and obligations included in this contract.

Conclusion and fulfilment of a contract

You acknowledge having read and accepted the conditions of the order especially information about product specifications, price, delivery, conditions for using the licence as well as the present General Terms and Conditions of Sale before having placed your order.

You declare having full legal capability to place and order and accept these General Terms and Conditions.  The contract is established as soon as the customer fills in and confirms the order form on the website and when EU4CMS has confirmed and processed the order.  Unless there is proof to the contrary, the data saved by EU4CMS serves as proof for all transactions made between EU4CMS and its customers.

Applicable law

The present contract is subject to French law.  This contract has been established in French.  In case of dispute French courts will have exclusive jurisdiction.
